Hadith 1351

Hadith.2917 - Harun ibn Hamzah al-Ghanawi narrated from Abu Abdullah (as) regarding a man who died without performing the Hajj of Islam and left behind only enough wealth for the expenses of Hajj, and he had heirs.
Imam (as) said
"They have the greater right to his inheritance. If they wish, they may use it for themselves, and if they wish, they may perform Hajj on his behalf."
2917 - رَوَى هَارُونُ بْنُ حَمْزَةَ اَلْغَنَوِيُّ عَنْ أَبِي عَبْدِ اَللَّهِ عَلَيْهِ اَلسَّلاَمُ
فِي رَجُلٍ مَاتَ وَ لَمْ يَحُجَّ حَجَّةَ اَلْإِسْلاَمِ وَ لَمْ يَتْرُكْ إِلاَّ قَدْرَ نَفَقَةِ اَلْحَجِّ وَ لَهُ وَرَثَةٌ قَالَ «هُمْ أَحَقُّ بِمِيرَاثِهِ إِنْ شَاءُوا أَكَلُوا وَ إِنْ شَاءُوا حَجُّوا عَنْهُ.
